2. CONTEST REGULATIONS FOR “CONTEST”

3. SUBJECT

The company UBISOFT ENTERTAINMENT SA, whose registered offices are at 28, rue Armand Carrel, 93108 Montreuil-sous-Bois Cedex, FRANCE (hereafter referred to as “UBISOFT”) is organising a free contest with no purchase necessary, based around the PC version of the ManiaPlanet game, entitled “Video Contest” and available at the address: http://www.maniaplanet.com.

4. DEFINITIONS

“Contest”: signifies the contest organised by UBISOFT in relation to the release of the PC version of the “ManiaPlanet” video game.

“Video game”: signifies the “ManiaPlanet” video game in PC format, distributed by UBISOFT and belonging to UBISOFT.

“Jury”: signifies the selection jury, made up of UBISOFT employees, that will decide the winners of the contest.

“Contest page”: signifies the web page for the contest, available at the address https://blog.maniaplanet.com/blog/2013/ ... niaplanet/ and situated on the website registered and managed by UBISOFT (https://blog.maniaplanet.com/blog/2013/ ... niaplanet/).

5. CONDITIONS FOR PARTICIPATION

Participation in the contest is open to any natural person living in Europe and possessing a postal address in Europe, except for members of the Jury, those having participated in the organisation of the contest, employees of UBISOFT, employees of any company controlled or partially controlled by UBISOFT, and any family members of these people (same name, same address).

Minors are allowed to participate, under the condition that they have prior parental consent (or that of their legal guardian) authorising them to do so. UBISOFT reserves the right to demand written proof of this at any moment, and to carry out any necessary check, as well to disqualify any participating minor who does not produce such authorisation immediately or within a reasonable amount of time that they are accorded. Any disqualification of a minor who has been chosen among the winners of the contest and thus earned one of the prizes described in article 6 of these regulations (referred to hereafter as “the regulations”) will lead to that person’s prize being attributed to the participant classed directly below him/her. The following rankings will be similarly modified, with the prizes redistributed according to this new ranking.

Access to this contest is limited to one participation per family (same name, same address) and per person, regardless of the number of e-mail addresses they have. If multiple participations are detected for the same person, for example via different e-mail addresses, the participant will be excluded from the contest.

Each participant must fill in all the required fields of the contest registration form on the contest page.

6. CONTEST DETAILS

The contest will start on 28th February 2013 at midnight and end on 25th March 2013 at 11.59pm (time zone: CET), with the reception date and time for the participants’ electronic replies being that recorded by UBISOFT’s computer systems.

Participants can obtain all the information and tools necessary for registration, and submit their responses, on the contest page. The contest section will be available for at least as long as the contest runs, except in the case of a technical incident.

Participants must submit 1 (one) video about one of the ManiaPlanet licence (TrackMania² Canyon, TrackMania² Stadium or ShootMania Storm). These video must be sent by e-mail to contest@nadeo.com with the subject “ManiaGala Video Contest – TITLENAME(Canyon/Stadium/Storm) – YOURNAME”. The e-mail sent by each participant must also include in the body of the message details of the video they have chosen to create. Only ManiaPlanet musics can be used on the video.

7. CHOOSING THE WINNERS

There will be 3 (three) winners of the contest, selected by the jury, based on creativity and the faithfulness of the videos to the world of the video games.

The list of winners will be available at the address http://www.facebook.com/ManiaPlanet from 30th March 2013.

The winners will also be personally notified, on or after 30th March 2013 with an e-mail sent to the address given when they registered for participation in the contest.
In this same e-mail, the winners will be told that their prize will be sent to the postal address given when they registered for participation in the contest.

If the winner has not received their prize with 21 (twenty-one) days of the above e-mail being sent, they have 90 (ninety) days following the publication of the winners’ names on the website to make this fact known to the organisers of the contest. If they do not, after this time, the winner forfeits their right to the prize initially attributed to them.

Under no circumstances can UBISOFT be held responsible for the loss of or damage to prizes by the postal system and/or the faulty functioning of their services.

8. CONTEST PRIZES

The prizes are as follows:

1st Prize: 1 (one) 400$ Amazon Gift Card.

The amounts indicated for the prizes correspond to those currently practised or estimated at the time the regulations were drawn up. They are given only as a rough indication and may be subject to change.

9. CONDITIONS FOR PRIZE ATTRIBUTION

Only one prize can be attributed per family (same name, same address). In order to qualify for the prize, the winner must fulfil the conditions defined in the regulations.

No prize attributed may be disputed by the winner, replaced by its equivalent money value or be replaced or exchanged under any circumstances. However, should UBISOFT find itself unable to provide any prize won, UBISOFT reserves the right to replace the announced prize with another of equivalent value or similar characteristics. The winners waive any right to claim damages from UBISOFT resulting from damage caused by the acceptance and/or use of the prize.

10. CONTEST REGULATIONS

UBISOFT reserves the right, if circumstances demand, to delay, modify or cancel the contest, to modify its duration, to make immediate and final decisions regarding any difficulties that may arise during the running of the contest. The responsibility of UBISOFT may not be invoked if, because of an unforeseeable, unavoidable and external event, UBISOFT is unable to uphold all or part of the regulations contained within this document.

11. PERSONAL DATA PROTECTION

The information supplied for the contest is destined for UBISOFT. UBISOFT informs participants that the nominative data supplied for the contest is processed automatically, and as such stored in a digital file that UBISOFT may use or sell.

The participant, if he/she is one of the winners, authorises UBISOFT to freely use their forename, surname, e-mail address and photos supplied for the contest without charge, for operations informing people about the contest, publication of the results and the promotion of the video game, in any media, for a period of 18 (eighteen) months starting from the date the winners are announced.

Upon request, participants have the right to access and rectify the data concerning them contained in the computer file, and may refuse that their contact details be used subsequently for advertising or promotional ends by contacting the following address: http://support.ubi.com

12. LIMITATION OF UBISOFT’S RESPONSIBILITY

Participation in the contest implies knowledge and acceptance of the characteristics and limitations of the Internet, especially with regard to technical performance, response times when consulting, requesting or transferring data, risks of service interruption and more generally the risks inherent for any connection and transfer of data on the Internet, the absence of protection for certain data against eventual misappropriation and the risk of infection by any virus that may eventually be present on the network.

Consequently, UBISOFT may not under any circumstances be held responsible for elements including but not limited to:

transmission and/or reception of any data and/or information on the Internet;
malfunction of the Internet network that may impede the contest from running or functioning;
failure of reception hardware or communication lines;
loss of e-mails and, more generally, the loss of any data;
delivery problems;
functioning of any software;
consequences of any virus, bug, anomaly or technical failure;
damage cause to a participant’s computer;
a technical, hardware or software failure of any kind they may stop or hinder participation in the contest or may have damaged a participant’s computer.

13. APPLICABLE LAW AND COMPETENT COURTS

In the case of this clause 11 not being found contrary to any publicly known legislation, the contest is governed by French law and will be subject to the competent French courts in application of the rules of the new Civil Procedure Code. Participation in the contest also implies accepting without reservation these regulations in their entirety, the rules of good conduct in force on the Internet and well as the laws, regulations and other texts applicable in France.
