The beta will be in NDA , ok , but if i make a vid with the use of action maker without showing the new stuff ( interface , new block ext ....) , a video like i made diff animation of the player to make cool scene ,does it count (more like a movie scene )?

Yes, since it's still using the Action Maker, a feature that's under NDA.
You can record videos, but not publish them or make them available to others in any way, shape or form before the NDA gets lifted.

1. Normally beta is in NDA, I hope it's this time too, but not sure.
2. Is your video showing something new: yes, the action maker.
3. Are you allowed to show new stuff in public: no.
4. Can you show the video before the NDA is released: no.

Appor, It sounds as you take it personal. but you shouldn't. TheM just tries to keep being objectiv and mentions the reasons why somebody wasn't invited for the closed beta.
Well, I have read a lot of your constructive feedback/suggestions so far. They are really helpful and not everyone would be able to offer such nice & detailed feedback.
Fortunately, Hylis said, that already invited tester will be able to invite people in the next beta-phase. For the simple reason that they don't know every dedicated and cooperative guy in this forum. So, players who are already invited in the beta, can invite these guys, who are very helpful and giving a lot suggestions/feedback ( as you )
If there is a chance, I'll invite you because I know that you would be very appropiate for the beta

The only thing I do not like about the way people are chosen for Beta is the fact that as a developer you can't work towards the new release. We run a server with a controller. We have big plans for the servers (and other stuff) and plan to use maniacontrol or write our own. I can't get my hands on maniacontrol cause they want to wait till the release of the new maniaplanet version. I also can't see the changes in the new maniaplanet version since I'm not part of the beta so I can't make the decision to either use Maniacontrol or write our own. Thus, when all is released I, as a developer, need to work it all out after the releases. I would rather have stuff done and ready when the release is done.

I can only say that the beta probably contains the developers of current server controllers. They are well-known in the community and with Nadeo and are chosen to be in the beta to prepare their controllers for the upcoming release and of course they have experience with the dedicated server and can provide Nadeo with feedback on that part of the update.
In your situation, I (as "developer") would wait until the upcoming ManiaPlanet 3 update. There are many updates expected and the dedicated API will probably be changed. Be on the save side and save yourself from extra work by having to recode your just coded controller.
Off-topic: as ManiaControl developer, the controller is going to be nice, but we want to release something that is ready for the (near) future and therefore wait to see what the beta will throw at us.

As far as I know, Hylis wasn't sure yet if there will be stupid games in this beta.
The beta is intended to be small, to have a good group of testers to get the bugs out of the system.
Probably the first wave of betatesters will be allowed to invite someone (or more, I don't know) into the beta to have a wider group of people, though keep control of who is in.
