Re: Questions & Answers Trackmania Turbo

Another question that hopefully gets answered: Where can I find the small print about uploading tracks in TMT? For instance, the Steam workshop sais it holds rights of uploaded creations as long as they are on their server. But users can still delete their creations and take away the copyright from Valve. Now how about Trackmania Turbo? Does Ubisoft claim copyright over user uploaded creations aswell? And if so why can't users delete their own creations and take back their copyright?

And here's the way I see copyright. First of all everyone who creates something automaticly holds copyright of that creation. Now Nadeo sees itself as an instrument builder so it's like selling a guitar and someone makes a song on the guitar and automaticly holds copyright over that song, and not the one who made the guitar. And the same should count for Trackmania, people have copyright of the tracks they built in TrackMania.

So I'd like to see the small print about copyright in Trackmania Turbo. And if it turns out Ubisoft or Nadeo claims copyright in anyway I'm outta here. Thanks in advance.

Found something. Ubisoft indeed sees any user generated content as their property. They call it "Derived UGC". Which is the opposite of how I see it with my example of the guitar. So if Ubisoft sells you a guitar it will say all songs you make with it are theirs (and, like in my case, you can't choose the artist name you want). Shame.

Item 6.3: https://www.ubisoft.com/en-US/terms-of-service.html

"If you do use any of the Materials to create any content, all of the Materials and any modified elements of the Materials (collectively, "User Modified Materials") will be solely owned by UBISOFT."

I have to let this one sink and make up my mind about releasing tracks in TMT. The fact is that other users have already released copies of my tracks, and others, under their name losing original credit in the process. I think classic tracks have become collective property but still, it's a sin on tmx and mx to release a track from someone else. And there are moderators to remove those tracks. So keeping credit and quality has always been a high priority in the fan run community. It makes me realize how lucky we have been all these years with tmx and mx. And this way my designs are already in the hands of Ubisoft. Now I don't expect Ubisoft to ever make money with my designs or do anything with them at all. For now it's mainly a conscientious objection to upload UGC (I used a dictionary for that word). :D

Rumor says your replays are automatically considered as "driven by Ubisoft" :roflol:

Here is the quote from the ICQ license agreements from back in 2005 that everything you write over ICQ belongs to the company owning ICQ.
You agree that by posting any material or information anywhere on the ICQ Services and Information you surrender your copyright and any other proprietary right in the posted material or information. You further agree that ICQ Inc. is entitled to use at its own discretion any of the posted material or information in any manner it deems fit, including, but not limited to, publishing the material or distributing it.

Interesting debate.
Not trying to defend either side of this but I kind of look at it this way...
When you write a song using a guitar, the song is yours because the arrangement of notes is your conceptual creation. It's the notes and way they are played that you are protecting with copyright. If you took the parts of that guitar though and rearranged them into another instrument, even stuck some of your own graphics on it and called it your own, then the company that created the guitar might have issue with it. In that sense I kind of get it.

But trackbuilder is a tool. If you buy a hammer then producer of this tool can't say that everything you made with this hammer is his property. :)

If I was new to the internet I wouldn't be concerned about copyright, I would be watching pron! :D But seriously I do think I have a point. There's a whole world out there to know about rights.

If you release something as public domain, you still keep copyright. But I know a track made inside an editor is a different case. Still, until last month we never had to deal with this and I'm trying to make a picture of the situation.

I also read the Steam Workshop TOS before I uploaded my tracks there and because I'm able to delete them again whenever I change my mind, I uploaded them. Until now I haven't deleted them. So just give me the ability to delete my own creations and I won't delete my own crations. I think Ubi's way if counter effective.

But I have so much fun playing TMT on console that I really want to upload my tracks there. I just need someone to tell me hush hush nothing will happen.

I totally get where you are coming from GanjaRider, and really for the most part agree with your perspective. I kind of thought someone from Nadeo would have weighed in on this by now. I haven't given in and created a U-Play account yet and likely will not, so I haven't even played TM Turbo yet and may never, but I don't get why you can't delete a track you have created and uploaded. Could it be that they don't want broken links if people have added them to a list?
