Exclude ingame menu being hidden in Hud Off mode

This issue was going through my title pack Nadeo Envimix for the whole time and I still can't come up with a solution on that.
Nothing seems to be in the MS documentation and I don't understand how it works in the Maker scripts. As I saw in official title packs the ingame menu hide on hud off is avoided.

The thing is that when pressing Escape with hud off, menu doesnt show up, the game controls will freeze and only thing to do something is to reload the whole game.

How is this done properly?
